Mediation is a voluntary process, meaning that it can only take place if both people want to commit to resolving the dispute in this way. Nobody can be forced to come to mediation, as the process depends on a willingness to talk about coming to an agreement. The fact that it is entirely voluntary reflects the understanding that the two of you are jointly in charge of what you do and do not agree: your mediator will offer impartial information on the legal framework, give you ideas and help you to communicate, as well as taking charge of the information that both of you will need to give and controlling the pace and general direction of the sessions. Your mediator will not take sides.
